Brazil extends the moratorium on taxes on China-related polyester yarn

On August 18, 2023, the Executive Committee of the Foreign Trade Commission of the Ministry of Development, Industry, Trade and Services of Brazil (Ministério do Desenvolvimento, Indústria, Comércioe Serviços/Câmara de Comércio Exterior/Comitê-Executivo de Gestão) issued Resolution 508 of 2023. Brazil decides to continue to suspend the imposition of final anti-dumping duties on non-retail polyester yarns (excluding sewing thread) (Portuguese: fios de filamentos sintéticos texturizados depoliésteres (exceto linhas para costurar), não acondicionados para venda aretalho, incluindo os monofilamentos sintéticos de título inferior a 67 decitex) originating in China and India, including synthetic filaments with fineness of less than 67 decibels, the suspension period will be extended for up to one year, and the measure will be terminated if it is not re-implemented when it expires. The tax numbers of the products involved are 5402.33.10, 5402.33.20 and 5402.33.90. This resolution shall enter into force as of the date of promulgation.

 

On March 5, 2021, the Brazilian Secretary of Foreign Trade issued notice No. 18 of 2021 in the Federal Government Gazette, saying that on the application of the Brazilian Association of Man-made and Synthetic Fiber products (Associa ã o Brasileira de Produtos de Fibras Artificiais e Sint é ticas (Abrafas)), an anti-dumping investigation was launched into polyester yarns originating in China and India, including synthetic fiber monofilaments with fineness less than 67 decibels, which were not available for retail use (excludingsewing thread). On September 30, 2021, the Brazilian Foreign Trade Secretary issued notice No. 64 of 2021 in the Federal Government Gazette, saying that a preliminary anti-dumping ruling had been made on the case, initially ruling that the products involved in the case were dumped and that dumping caused damage to Brazil's domestic industry, but temporary measures would not be taken for the time being. On August 22, 2022, the Executive Committee of the Foreign Trade Commission of the Ministry of Economic Affairs of Brazil (GECEX) issued Resolution No. 385 of 2022, making a final determination of anti-dumping on the case, and decided to impose anti-dumping duties on the products involved in China and India for a period of five years, which were US$57.85-585.70/ton for China and US$105.67-558.57/ton for India. In view of the public interest in Brazil, the measure was suspended for one year.
